Welcome to Menumigo! By accessing or using our digital menu platform and related services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you and Menumigo. Please read them carefully before using our Services.

2. Description of Services

Menumigo provides a digital menu management platform that allows restaurants and food service businesses to:

• Create and manage digital menus
• Generate QR codes for menu access
• Translate menus into multiple languages
• Track analytics and customer engagement
• Manage loyalty programs and promotions
• Access AI-powered tools for menu optimization

2.1 Loyalty Program

Our loyalty stamp card feature allows restaurant customers to collect stamps toward rewards. By using this feature, you acknowledge and agree that:

• Loyalty stamps are tracked using an anonymous token stored in your browser's local storage. No personal account or login is required.
• Your stamp progress is tied to a specific browser on a specific device.
• Clearing your browser data, switching browsers or devices, or using incognito/private browsing mode will permanently and irreversibly erase your stamp progress.
• Menumigo is not responsible or liable for any lost stamp progress resulting from actions described above.
• There is no account-based recovery mechanism. Lost stamps cannot be recovered, transferred, or restored under any circumstances.
• Reward redemption is subject to the participating restaurant's policies and availability.

3. Account Registration

To use certain features of our Services, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account and use our Services.

4. Subscription and Billing

4.1 Free and Paid Plans

Menumigo offers both free and paid subscription plans. The features available to you depend on your subscription level. Detailed plan information is available on our pricing page.

4.2 Payment Terms

• Paid subscriptions are billed in advance on a monthly or annual basis
• All fees are non-refundable unless otherwise specified
• We may change pricing with 30 days notice
• You authorize us to charge your payment method for all applicable fees

4.3 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will continue to have access to paid features until the end of your current billing period. After that, your account will revert to the free plan.

5. Acceptable Use

You agree not to use our Services to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the integrity of our Services
• Collect or harvest user data without consent
• Use the Services for any fraudulent or deceptive purposes
• Upload content that is illegal, harmful, or offensive

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of all content you upload to Menumigo, including menu items, descriptions, images, and other materials ("Your Content"). By uploading content, you grant us a worldwide, non-exclusive license to use, display, and distribute Your Content solely for the purpose of providing our Services.

6.2 Our Intellectual Property

Menumigo and its licensors own all rights to the Services, including the platform, software, design, logos, and trademarks. You may not copy, modify, distribute, sell, or lease any part of our Services without our written permission.

7. Privacy

Your use of our Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using our Services, you consent to the practices described in our Privacy Policy.

8. Disclaimers and Limitations

8.1 Service Availability

We strive to provide reliable Services, but we cannot guarantee uninterrupted or error-free operation. The Services are provided "as is" and "as available" without warranties of any kind.

8.2 Limitation of Liability

To the maximum extent permitted by law, Menumigo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data, or goodwill, arising from your use of our Services.

9. Indemnification

You agree to indemnify and hold harmless Menumigo, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

We may suspend or terminate your access to the Services at any time, with or without cause or notice. You may also terminate your account at any time by contacting us or using the account settings.

Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.
